General conditions of use

Purpose of the Terms of Use (CGU):
These General Terms of Use (hereinafter "CGU") define the contractual framework of the relationship between Hopscotch Congrès and the User of the website festival-diapason-megeve (hereinafter the "Site"). They set the rules for accessing the Site and its usage conditions, which every user acknowledges and agrees to without reservation by simply connecting to the Site.

Hopscotch Congrès reserves the right, at any time, to modify, supplement, delete, or more generally update all or part of these terms of use. Hopscotch Congrès will inform each visitor of the Site (the "User") of any changes made to these terms of use.

If the User does not comply with these terms of use, and Hopscotch Congrès does not take immediate action in response, this shall in no way be interpreted as Hopscotch Congrès waiving its rights to act at a later time.

 

Content of the Site:
The purpose of the Site is to provide information related to the activities and news of the Paris World Cup, as well as to allow users to register for events. The information on the Site is for general and indicative purposes only and is in no way exhaustive.

Hopscotch Congrès reserves the right to modify, at any time and without prior notice, the content of the Site or to suspend or interrupt access to it. Despite all the care and attention given to the creation of the Site and its regular updates, errors may have occurred in the information presented. Users of the Site should therefore carry out all necessary checks and are solely responsible for their use of the information available, without Hopscotch Congrès being held liable.

Hopscotch Congrès makes every effort to provide Users with available and verified information and/or tools, but cannot be held responsible for errors, the unavailability of information, or the presence of viruses on its site.

User's Commitment:
The User of the Site acknowledges having the necessary skills and means to access and use the said website.
The User of the Site acknowledges having verified that the computer configuration used does not contain any viruses and is in perfect working condition.
The User must not use the Site or its content for any unlawful purpose or for any purpose prohibited by these Terms of Use, nor to encourage any illegal activity or any activity that infringes the rights of Hopscotch Congrès or any third party.

The User is not authorized to use devices, programs, algorithms, or other automatic methods to access, acquire, copy, or monitor any part of the Site, nor to reproduce or bypass the Site's navigational structure or presentation to obtain data, documents, or information. The User may only extract and/or reuse data, documents, or information from the Site when explicitly authorized to do so.

The User must not attempt to access any section or feature of the Site, or any other system or network connected to the Site, nor any services offered on the Site, by hacking or any other illegitimate means.

The User must not attempt to analyze or test the vulnerability of the Site or any network connected to the Site, nor breach the security and authentication measures implemented on the Site or the networks connected to the Site.

The User is not authorized to query or trace information about other Users, or Hopscotch Congrès customers, including any User account that they do not own or its source, nor to exploit the Site, its services, or any information made available through the Site, in any way, to disclose such information, including personal identification details or any other information other than their own, as it appears on the Site.

The User agrees not to take any action that would impose an excessive or unreasonable load on the infrastructure of the Site, or on Hopscotch Congrès' systems or networks, or on any system or network connected to the Site or to Hopscotch Congrès.

The User agrees not to use any device or software to interfere or attempt to interfere with the proper functioning of the Site or any transaction conducted on the Site, or the use of the Site by any other person.

The User must not attempt to forge headers or manipulate identifiers in any way to disguise the origin of a message or transmission sent to Hopscotch Congrès via the Site, or any service offered through the Site. The User must not impersonate or represent someone else, nor pretend to be another individual or legal entity.

Hopscotch Congrès reserves the right, at any time, to modify or temporarily or permanently interrupt the use of this Site and shall not be held responsible for these changes, suspensions, or interruptions. Hopscotch Congrès also disclaims any liability for malfunctions or interruptions in the use of the Site due to power failures, telephone and/or internet line failures, or any other event beyond its control.

 

Technical Information:
Hopscotch Congrès cannot be held responsible for elements beyond its control and for any damages that may be suffered by the User's technical environment, including their computers, software, network equipment, and any other material used to access the Site and/or the information contained therein.
Transmissions via the internet network are never entirely confidential and secure. It is the responsibility of each User to take all appropriate measures to protect their own data and/or software from potential viruses circulating on the Internet.
The User agrees to indemnify and hold Hopscotch Congrès harmless from any loss or claim resulting from actions taken by third parties due to or in connection with their own use of the Site.

 

Disclaimer of Warranty:
Hopscotch Congrès strives to keep the Site up to date. However, Hopscotch Congrès cannot guarantee the accuracy or completeness of the information made available, whatever it may be.
Therefore, and to the extent permitted by applicable law, Hopscotch Congrès disclaims all liability for any indirect damage, whatever the cause, origin, nature, or consequences, that may arise from a visit to the Site or be associated with it, including but not limited to, any loss of profit, business interruption, or loss of software or data.

Hyperlinks:
The creation of hyperlinks to the Site is subject to the prior and express consent of Hopscotch Congrès.
The Site may contain hyperlinks to other websites. The existence of a hyperlink between the Site and a third-party website does not in any way mean that Hopscotch Congrès approves the content of that site or the use that could be made of it, and it cannot, under any circumstances, be held liable for it. The User visits the other sites at their own risk and responsibility.
Hopscotch Congrès cannot be held responsible for the access provided by users through hyperlinks set up on the Site leading to other resources available on the internet network.
It is reminded that delays, omissions, or inaccuracies may occur due to the electronic transmission system.

Copyright – Intellectual Property:
All elements of the Site, whether individually or as a whole, are subject to the applicable legislation on intellectual property, copyright, and trademark law, both in terms of form (structure, arrangement of data, design, usability…) and content (trademarks, texts, images, illustrations, music, sounds…). These elements are the exclusive property of Hopscotch Congrès or are licensed to them, and Hopscotch Congrès is the sole authorized user. Any reproduction, representation, or distribution, in whole or in part, of the pages, data, and any other element of the Site, by any means or medium, as well as any modification, is prohibited, unless prior written authorization is obtained from Hopscotch Congrès. Such acts would constitute copyright infringement, punishable under Articles L.335-2 and following of the French Intellectual Property Code.
The trademarks of Hopscotch Congrès and its partners, as well as the logos displayed on the Site, are semi-figurative or not and are registered. Applicable Law and Jurisdiction:
These Terms and Conditions of Use are governed by French law. In the event of a dispute, the parties will seek an amicable solution. If no agreement is reached, the courts within the jurisdiction of the Paris Court of Appeal will have exclusive competence to resolve any dispute related to the validity, interpretation, or enforcement of the T&Cs, even in the case of multiple defendants or third-party claims. The User acknowledges this by accepting these terms.
